Terms of Service

Please read these terms carefully before using the Gatiman platform. By accessing our services, you agree to be bound by these terms.

Acceptance of Terms

Thank you for using Gatiman - Dr. Kana Pvt Ltd (“App”) Services. These Terms of Use, together with Gatiman - Dr. Kana Pvt Ltd Privacy Policy (“Terms of Use”), shall apply to the users of the app as and when they visit, browse, access data and, place orders, upload or download documents, access or otherwise use the App.

By using the App, you acknowledge and signify that you have read, understood, and agree to be bound by these Terms of Use. You must agree to these Terms of Use in order to access or use the App. You may not use the services if you do not accept the terms or are unable to be bound by the terms.

1. Scope of these terms

These Terms of Use only apply to your activities when using the App or its contents. The following General Terms of Use apply to all services rendered between Gatiman - Dr. Kana Pvt Ltd and Users of this app/site whether as a consignor, consignee, lorry/ truck (Vehicle) owner or in any other capacity. The Gatiman - Dr. Kana Pvt Ltd through this app provides a platform that enables consignors, consignees and vehicle owners, transport contractors and agents to meet, approach, compare, place orders or enter into contracts or transactions to make easy and seamless transportation, conveyance or movement goods from one place to another. Deviations from these conditions are only binding if confirmed in writing and these General Terms of Use will apply to all additional services or revised services.

2. Eligibility

By using the App, you represent and warrant that you are at least 18 (eighteen) years of age and are competent to enter into a binding contract under the Indian Contract Act, 1872. If you are registering or transacting on behalf of a company, partnership, or other entity, you represent and warrant that you have the authority to bind such entity to these Terms of Use. The App is not intended for use by minors, and any account found to belong to a minor is liable to be suspended or terminated without notice.

3. User’s Obligation

The users agree not to:

  • Use the services to obtain unauthorized access to the services, systems, network or data;
  • Violate any applicable laws or regulations;
  • Make available any content that you do not have the right to make available or that infringes any patent, trademark, copyright or other proprietary rights of any person or entity;
  • Make available viruses or any other computer code, files, programs or content designed to interrupt destroy or limit the functionality of the services and affect other users;
  • Interfere with or disrupt the services or servers, systems or networks connected to the services in any way.
4. Confidentiality

The Gatiman - Dr. Kana Pvt Ltd app: each party is obliged to treat any data and information not publicly accessible as confidential and to use these exclusively for the purpose intended.

The confidentiality rule does not apply to data and information that must be passed on to third parties, especially public authorities, due to legal obligations. The other party is to be informed about such obligation without delay.

5. Limitation of Liability and Warranties

The Gatiman - Dr. Kana Pvt Ltd app:

  • Shall in no event be liable for any direct, indirect, special, consequential or other damages arising out of the use of this app or any information or images contained therein, including without limitation, lost profits, business interruption and loss of programs or other data;
  • Shall not take responsibility or liability for the pricing and payment terms of contract entered between Vehicle owner and consignor/consignee, transport contractors and agents using this app as a platform;
  • Shall not take responsibility or liability for any dispute arising between consignor or consignee or vehicle owner(or Lorry provider) or driver regarding quantity, quality, packing, assembling, etc. of goods conveyed with the help of this Application;
  • Shall be harmless from any and all claims, losses, damages, and liabilities, costs and expenses, including without limitation legal fees and expenses, arising out of or related to use or misuse of the services or of the app, any violation by user of these Terms of Use, or any breach of the representations, warranties, and covenants made herein;
  • Shall not be liable for any late pickup, late delivery, early arrival, early delivery any waiting charges and also if user procure the freight without pickup service and/or delivery service, they themselves are responsible for delivering the shipment to the designated drop-off and/or pickup point;
  • Shall not be responsible for goods or services or the terms on which services may be procured or availed using this application as a platform. If user chooses to procure or avail such goods or services, user should carefully evaluate them and the terms upon which you are availing them;
  • Shall not be responsible for any natural loss, damage, deterioration of goods involved including on account of pilferage, theft, accident, natural calamity or any other similar cause;
  • Shall not be liable for any conduct of the drivers of the vehicles. Users may notify complaints against driver of any vehicle that you may have hired using this platform;
  • Shall not be liable for performance of service as earlier agreed by user parties;
  • Shall penalize the load owner, by charging a cancellation fee, if he/she refuses to load the shipment when lorry owner reaches the destination as specified by load owner, when the load owner had actually booked for the service and had paid the advance to Gatiman - Dr. Kana Pvt Ltd ;
  • May ask you for feedback of listed vehicles users from whom the users would have availed services;
  • Shall withhold the user’s money in case the user is engaged in any fraudulent or malicious behaviour on the platform; and
  • May contact the user, in any way, in case money is credited to user’s account due to any technical glitch caused by Gatiman - Dr. Kana Pvt Ltd and the user shall credit the exact amount transferred by Gatiman - Dr. Kana Pvt Ltd within 10 (ten) days of such request by Gatiman - Dr. Kana Pvt Ltd. In case the user does not credit the amount within the prescribed time as mentioned in this clause, Gatiman - Dr. Kana Pvt Ltd shall have the right to approach the court against the user.
The user of app acknowledges and agrees that they shall be liable for checking the contents, packing, sealing, addressing, labeling and handling of the goods, carriage, shipping instruction or waybill.
6. Intellectual Property

The Gatiman - Dr. Kana Pvt Ltd name and logo, and other trademarks, service marks, graphics and logos used in connection with the App are trademarks of Gatiman - Dr. Kana Pvt Ltd. Other trademarks, service marks, graphics and logos used in connection with the App are the trademarks of their respective owners (collectively “Third Party Trademarks”). The Gatiman - Dr. Kana Pvt Ltd Trademarks and Third Party Trademarks may not be copied, imitated or used, in whole or in part, without the prior written permission of the applicable trademark holder. The App and the content featured in the App are protected by copyright, trademark, patent and other intellectual property and proprietary rights which are reserved to the trademark holder and its licensors.

7. Indemnity and limitation of liability
  • In case any loss or damage occurs to us due to your failure to provide us the correct information, or due to your engagement in any such activity on our platform, which may be in violation of the applicable law in India, you shall indemnify us from such damage or loss.
  • You shall be bound by the Terms of Use, and shall be liable to indemnify us wholly, if you breach any provision of the Terms of Use.
  • You agree that we shall not be liable for any illegal or offensive conduct of any third party on our platform. Further, we shall not be liable for any delay or inaccuracy in information provided by any third party on our platform.
  • Any dealing between you and the third-party, on or through our platform, including the delivery of product or service, payment, conditions etc., shall be between you and the third-party only. We shall not be liable for any damage or loss pertaining to such dealings.
8. General law and Jurisdiction

Except as otherwise set forth in these Terms, these Terms shall be governed by Indian laws. Subject to the mediation and arbitration provisions set out below, the courts at Mumbai, India shall have exclusive jurisdiction to grant interim or interlocutory relief and to enforce any award rendered pursuant to such arbitration.

If any provision (or part of a provision) of these App Terms is found by any court or administrative body of competent jurisdiction to be invalid, unenforceable or illegal, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

Any dispute, conflict, claim or controversy arising out of or broadly in connection with or relating to the Services or these Terms, including those relating to its validity, its construction or its enforceability (any “Dispute”) shall be first mandatorily submitted to mediation proceedings in terms of the Indian law. If such Dispute has not been settled within sixty (60) days after a request for mediation has been submitted under the Indian laws, such Dispute can be referred to and shall be exclusively and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996 (“Act”). The Dispute shall be resolved by one (1) arbitrator to be appointed by Gatiman - Dr. Kana Pvt Ltd. The place of both mediation and arbitration shall be Mumbai, India. The language of the mediation and/or arbitration shall be English, unless you do not speak English, in which case the mediation and/or arbitration shall be conducted in both English and your native language. The existence and content of the mediation and arbitration proceedings, including documents and briefs submitted by the parties, any correspondence from the mediator, and correspondence, orders and awards issued by the sole arbitrator, shall remain strictly confidential and shall not be disclosed to any third party without the express written consent from the other party unless: (i) the disclosure to the third party is reasonably required in the context of conducting the mediation or arbitration proceedings; and (ii) the third party agrees unconditionally in writing to be bound by the confidentiality obligation stipulated herein.

9. Amendment to the Terms of Use

We may amend or alter the Terms of Use from time to time. Any changes to this Terms of Use shall become effective upon posting of the revised Terms of Use on the platform. In the case of any material change that affects your rights or obligations, we shall make reasonable efforts to notify you through the App, by email, or by other appropriate means prior to such change taking effect. It is recommended that you regularly check this Terms of Use to apprise yourself of any updates.

10. Miscellaneous
  • The Terms of Use shall not create any partnership or agency between you and us.
  • Each obligation is separate from the other obligations of this Terms of Use. If one or more of the obligations contained in these Terms of Use is held invalid, illegal or unenforceable in any respect by any court of competent jurisdiction, such holding will not impair the validity, legality, or enforceability of the remaining obligations.
  • Time is of utmost importance for all the matters relating to the Terms of Use.
  • The time when you access the platform, the Terms of Use shall stand duly executed between you and us.

Privacy Policy (“Policy”) describes the policies and procedures on the collection, use, disclosure and protection of your information when you use our website/app located at https://www.gatiman.co , or the Gatiman - Dr. Kana Pvt Ltd mobile application (collectively, “This Platform”) made available to Gatiman (“Company”, “we”, “us” and “our”), a private limited company incorporated under the laws of India having its registered office at 316, 3rd Floor, Midas Building Sahar Plaza, Andheri East, Mumbai - 400059.

1. Company Information:

Gatiman - Dr. Kana Pvt Ltd is a technology company that has developed an app that connects users (Transporter) with driver partners who provide services to the user for transporting the goods from one place to another. We provide services for efficient movement of goods and passengers. Our team has experience in the transportation industry which helps them understand the user needs and provide efficient services thereby specializing in on demand scheduled transport services like last mile delivery, commercial transportation of goods along with fleet services.

Users can use the App to request transportation via their smartphone, the web, or via SMS.

Gatiman - Dr. Kana Pvt Ltd is neither a transportation carrier, nor employ any drivers.

Users can choose from a variety of vehicles as per their needs at their location.

At the end of the ride, both the driver partner and user receive a copy of the fare receipt. More information about our services is available here.

We store and maintain information as described in our Privacy Statements and our Terms of Use.

2. App Description

This Platform is a mobile and web application that connects consignors and consignees seeking to transport goods with vehicle owners, transport contractors, and driver partners who can fulfil such transportation requirements. Users can search for available vehicles, compare service providers, place transportation orders, track shipments, and make payments through the App.

3. Purpose of Privacy Policy

Our commitment is to be transparent about the data we collect about you, how it is used and with whom it is shared.

4. Information collected through the Application

When you use our Services, we collect information about you in the following general categories:

  • Location Information: When you use our services, we collect location data about the delivery transaction involved. If you permit the app to access location services through the permission system used by your mobile operating system, we may also collect the precise location of your device when the app is running in the foreground or background.
  • Transaction Information: We collect transaction details related to your entering into any transaction with any other user of this app procuring/rendering services including type of service requested, Date, time, place, distance involved, and other related transaction details.
  • Usage and Preference Information: We collect information about how you interact with our services, other users, preferences expressed and settings chosen. In some cases we do this through the use of cookies and other similar technologies that create and maintain unique identifiers.
  • Device Information: We may collect information about your mobile device including for example operating system and version, software and file names, preferred language, etc.
  • Log Information: When you avail the services, we may collect server logs, which may include information like device IP address, access dates and times, app features or pages viewed, app crashes and other system activity, type of browser, etc.
5. Purpose of Data Collection

We primarily use the information including but not limited to following purposes:

  • To facilitate your usage of our services;
  • To process or facilitate payments for Services;
  • To Contact you with promotional offerings or other communications that may be of interest to you;
  • To contact you in connection with your Services;
  • To perform internal operations necessary to provide our Services, troubleshooting software bugs and operational problems, to conduct data analysis, testing, research, and to monitor and analyse usage and activity trends;
  • To personalize the content and features you see when you visit our sites or use our plug-in;
  • To respond to your questions and assist with problems with our Services;
  • To enhance other information, we have about you to help us better understand you and determine your interests;
  • To assist you when you contact our customer support services, including a) Direct your questions to the appropriate customer support person, b) Investigate and address your concerns, c) Monitor and improve our customer support responses;
  • For product development. This allows us to improve and enhance the safety and security of our Services, develop new features and products;

Sharing of Information

We do not share or transfer your personally identifiable information with outside parties. This does not include our trusted third parties who assist us in operating our app, conducting our business and also they agree to keep your information confidential.

6. Data Sharing:
  • To comply with laws and to respond to lawful requests and legal process,
  • To protect the rights and property of the company, our users, and others, including to enforce the terms,
  • In an emergency to protect the personal safety and assets of the company, the users or any person.
In such an event we are in no manner responsible for informing you or seeking your approval or consent

We do not allow account sharing the same is operated by end user. Proper verification is done by verifying mobile number so that unauthorized access is restricted. It is always advised that end user use strong password and add details for recovery of password. Suspicious account is closed.

9. Why We Collect This Data

The purpose of this policy is to ensure that the information of / provided by any Users visiting the Application is stored in accordance with the applicable laws. The information stored in such manner shall be protected us via a secure server software, which is the industry standard and among the best software available today for secure transactions.

Fair Policy

Cancellation & Refund Policy

We aim to make cancellations and refunds simple, fair, and transparent for both Customers and Drivers.

1. Cancellations by Customer

Before Bid Acceptance

Customers may cancel a posted shipment lead at any time before a bid is accepted without any cancellation fee. The lead will be removed from active listings immediately.

After Bid Acceptance — Before Pickup

If a Customer cancels after accepting a Driver's bid but before the driver reaches the pickup point:

  • A cancellation fee equivalent to 10% of the agreed fare will be levied.
  • The fee is collected to compensate the Driver for time and fuel already expended.

After Pickup (In Transit)

Cancellations after the shipment has been picked up are not permitted except in exceptional circumstances (e.g., vehicle breakdown, force majeure). Disputes in such cases will be handled by the Gatiman support team on a case-by-case basis.

To cancel a shipment, navigate to your active leads in the Gatiman app and select "Cancel Shipment", or contact support at support@gatiman.co with your lead ID.
2. Cancellations by Driver

We understand that circumstances change. However, cancellations by Drivers after a bid is accepted negatively impact Customer experience and platform reliability.

  • First cancellation within 30 days: Warning issued.
  • Second cancellation within 30 days: Temporary restriction on bidding for 24 hours.
  • Three or more cancellations within 30 days: Account review; potential suspension.

Cancellations due to verified force majeure (accident, medical emergency, severe weather) will not count towards this limit. Drivers must notify Gatiman support within 2 hours with appropriate documentation.

3. Refund Process

Where a refund is applicable, the following timelines apply:

  • UPI / Net Banking: 2–3 business days after approval.
  • Credit / Debit Card: 5–7 business days after approval (depending on your bank).
  • Wallet Credit: Instant — credited to your Gatiman wallet for use in future bookings.
To initiate a refund, contact us at support@gatiman.co with your Lead ID, payment reference, and reason for refund within 7 days of the transaction.

Please note that Gatiman's platform fee (if applicable) is non-refundable once a bid has been matched and accepted.

4. Incorrect or Disputed Deliveries

If goods are damaged, lost, or not delivered as agreed, please follow these steps:

  • Note any visible damage on the delivery receipt before signing.
  • Take clear photographs of the goods and packaging.
  • Contact Gatiman support at support@gatiman.co within 24 hours of delivery with your Lead ID, photos, and a description of the issue.

If the issue is confirmed as the Driver's error or platform error, Gatiman will cover return/compensation logistics and the cancellation/platform fee will be fully waived.

Gatiman facilitates dispute resolution but is not liable for the value of goods. Customers are advised to obtain appropriate cargo insurance for high-value shipments.
5. Refused or Undeliverable Shipments

If a shipment is refused by the receiver or is undeliverable due to incorrect address or other Customer-side factors, and Gatiman is not at fault:

  • Any return freight costs will be deducted from the applicable refund.
  • The platform fee is non-refundable in such cases.
  • The Driver will be compensated for completed mileage as per the original agreed fare.
